Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of the Skhillz Script™ website, application, learning platform, related services, content, subscriptions, and features (collectively, the “Service”). Skhillz Script™ is operated by Skhillz Academy, LLC (“Skhillz Academy,” “we,” “us,” or “our”).
By creating an account, purchasing a subscription, authorizing a child to use the Service, using the Service on behalf of an organization, or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About Skhillz Script™
Skhillz Script™ is a digital cursive-writing learning and practice platform designed to provide guided cursive instruction, letter-formation demonstrations, interactive handwriting practice, progress tracking, feedback, and related educational tools.
Skhillz Script™ is a standalone product operated by Skhillz Academy, LLC.
2. Adult Account Holder Required
A child may use Skhillz Script™ through an authorized child or learner profile, but a child under 18 may not independently enter into these Terms or purchase a subscription.
Consumer accounts must be created and controlled by a parent or legal guardian who is at least 18 years old. School, organization, tutor, or professional accounts must be created or authorized by an adult who has authority to act for the applicable customer.
The adult account holder is responsible for the account, authorized learner profiles, maintaining accurate information, supervising use by minors as appropriate, protecting login credentials, and complying with these Terms.
3. Children Under 13 and Parental Consent
Skhillz Script™ is designed for use by children and may collect personal information from children under 13 in connection with learner profiles and educational activities.
We do not knowingly collect covered personal information directly from a child under 13 until the required verifiable parental consent or other legally valid authorization has been obtained, except where a limited exception is permitted by law.
Parents and guardians should review the Skhillz Script™ Privacy Policy and Skhillz Script™ Children’s Privacy Notice and Parental Consent Notice.
Children under 13 may not create independent consumer accounts.
4. School and Educational Institution Use
Schools, school districts, and other educational institutions may license Skhillz Script™ under separate institutional terms.
Where a school or district provides access to Skhillz Script™ and shares student education records or other student information with us, the Skhillz Script™ School Data Privacy and FERPA Addendum applies when incorporated into the applicable institutional agreement.
Skhillz Academy does not represent that every customer or every use of the Service is subject to FERPA. Where a covered school provides education records under an authorized arrangement, we process them according to the institutional agreement and applicable law.
Where a school provides COPPA authorization on behalf of a parent for school use, the authorization applies only to the educational context for which the school has authority to act. Student information collected under school authorization will not be used for unrelated advertising, behavioral profiling, or unrelated commercial purposes.
5. Accounts and Security
You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of account credentials and for activity conducted through your account.
You must notify us promptly at support@skhillzacademy.org if you believe an account has been compromised, an unauthorized person has accessed a learner profile, login credentials have been disclosed, or another security issue has occurred.
We may require password resets, additional authentication, or other reasonable security measures.
6. Subscriptions, Fees, and Renewal
Consumer subscription prices, billing periods, trial terms, founding-member offers, discounts, and renewal terms are displayed at checkout or in the applicable offer.
Unless the purchase terms expressly state otherwise, paid subscriptions automatically renew at the interval disclosed at checkout until canceled.
By purchasing an automatically renewing subscription, the adult account holder authorizes the applicable recurring charges until cancellation.
Prices may change for future billing periods. Where required, notice of a price change will be provided before it takes effect. Taxes may be added where required.
Institutional, professional, reseller, and enterprise pricing may be governed by separate agreements.
7. Cancellation and Refunds
Consumer subscriptions may be canceled through the available account-management process or other method provided by Skhillz Academy.
Cancellation stops future renewal charges but does not ordinarily create a refund for a billing period that has already begun unless the applicable offer states otherwise, required by law, or approved by Skhillz Academy.
Any specific refund or satisfaction policy displayed at checkout is incorporated into these Terms.
8. Personal and Household Licenses
A family or consumer subscription is licensed only for personal household use by the number of learners permitted under the purchased plan.
A consumer account may not be used to manage unrelated tutoring clients, operate a classroom, provide commercial instruction to unrelated learners, sublicense access, resell access, or create unauthorized learner accounts for third parties.
Professionals and organizations must use the appropriate professional or institutional plan where applicable.
9. Acceptable Use
You may not use the Service to violate law or another person’s rights; gain unauthorized access; interfere with the Service; scrape or harvest data except as expressly permitted; reverse engineer except where applicable law expressly permits it; distribute malware; impersonate another person; falsify parent, learner, school, or billing information; bypass subscriptions, seat limits, parental consent, security controls, or other restrictions; use learner data for unauthorized advertising, profiling, or commercial exploitation; or resell, sublicense, or commercially distribute the Service without written authorization.
We may suspend or terminate access for material violations.
10. Educational Content and Learner Practice
The Service may include letter demonstrations, guided practice, freehand writing, stroke or handwriting submissions, scoring or match feedback, progress reports, instructional recommendations, achievements, or completion data.
Feedback and scoring are educational tools and may not perfectly evaluate every handwriting attempt.
Parents, educators, and learners should use the Service as one instructional resource rather than as the sole basis for a high-stakes educational, medical, therapeutic, or diagnostic decision.
11. Learner Content and Handwriting Data
Learners may create handwriting strokes, practice submissions, responses, or other content while using the Service (“Learner Content”).
The user retains any rights they may have in Learner Content.
The adult account holder grants Skhillz Academy a limited license to host, process, reproduce, and analyze Learner Content only as reasonably necessary to provide the Service, score or evaluate practice, display progress, maintain account history, improve reliability and functionality using appropriately permitted data, and satisfy legal obligations.
For children’s personal information, this license is subject to the Privacy Policy, Children’s Privacy Notice, COPPA, and applicable law.
Skhillz Academy does not use a child’s handwriting to create a biometric identity profile or to authenticate the identity of the child unless we separately disclose that feature and obtain any consent required by law.
12. Intellectual Property
The Service and its content, including software, design, letter demonstrations, graphics, curriculum content, logos, trademarks, interfaces, text, audiovisual material, and other proprietary materials, are owned by or licensed to Skhillz Academy and are protected by applicable intellectual-property laws.
Skhillz Script™ and related marks are trademarks of Skhillz Academy, LLC.
Third-Party Materials
Cursive letterforms displayed in the Service are set in Playwrite USA Traditional, used under the SIL Open Font License, Version 1.1. The license text is available at /fonts/OFL.txt. Skhillz Academy claims no ownership of that typeface, and the typeface is not licensed to users of the Service beyond its display within the Service.
Except for the limited right to use the Service under an active subscription or license, no intellectual-property rights are transferred to the user.
13. Feedback
If you voluntarily submit suggestions, feature ideas, or general product feedback that does not contain protected student or child data, you permit Skhillz Academy to use that feedback without restriction or compensation.
This provision does not authorize us to use protected child or student information outside the permissions described in our privacy documents.
14. Third-Party Services
The Service may rely on third-party service providers for hosting, authentication, payment processing, email delivery, customer support, analytics used for service operations, security, and infrastructure.
Our handling of personal information and our requirements for service providers are described in the Privacy Policy.
Third-party services may have separate terms governing a user’s direct relationship with them.
15. Privacy
Our collection, use, disclosure, protection, retention, and deletion of personal information are governed by the Skhillz Script™ Privacy Policy, Skhillz Script™ Children’s Privacy Notice and Parental Consent Notice, and, where applicable, Skhillz Script™ School Data Privacy and FERPA Addendum.
Those documents are incorporated into these Terms by reference where applicable.
16. Service Changes and Availability
We may update or modify the Service to improve functionality, add or remove features, address security or legal requirements, update instructional content, maintain compatibility, or correct errors.
We do not guarantee uninterrupted or error-free availability.
Where a material change affects a paid subscription, we will provide notice where required by law or the applicable agreement.
17. Suspension and Termination
We may suspend or terminate access if reasonably necessary because of nonpayment, fraud, security concerns, violation of these Terms, unauthorized commercial use, misuse of child or student data, or legal or regulatory requirements.
A parent may request account and child-data deletion as described in the Privacy Policy and Children’s Privacy Notice.
Institutional data disposition is governed by the applicable institutional agreement and School Data Privacy and FERPA Addendum.
18. Educational Disclaimer
Skhillz Script™ provides educational instruction and practice. It does not provide medical advice, psychological advice, occupational-therapy services, special-education eligibility determinations, medical or learning-disability diagnosis, or legal advice.
No specific learning outcome is guaranteed.
The separate Skhillz Script™ Website and Educational Disclaimer contains additional information and is incorporated into these Terms.
19. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
SKHILLZ ACADEMY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.
WE DO NOT WARRANT THAT THE SERVICE WILL ALWAYS BE AVAILABLE, EVERY ERROR WILL BE CORRECTED, EVERY DEVICE OR BROWSER WILL BE COMPATIBLE, AUTOMATED OR COMPUTATIONAL FEEDBACK WILL BE PERFECT, OR A LEARNER WILL ACHIEVE A PARTICULAR EDUCATIONAL RESULT.
Nothing in these Terms excludes a warranty or consumer right that applicable law does not permit us to exclude.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKHILLZ ACADEMY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITY, LOSS OF GOODWILL, OR LOSS OF DATA, ARISING OUT OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM A CONSUMER’S USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF: (1) THE AMOUNT PAID BY THAT CUSTOMER TO SKHILLZ ACADEMY FOR SKHILLZ SCRIPT™ DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (2) ONE HUNDRED DOLLARS ($100).
These limitations do not apply to liability that cannot lawfully be limited.
21. Indemnification for Business and Institutional Users
To the maximum extent permitted by law, a professional, organization, school, reseller, or other business customer agrees to indemnify Skhillz Academy against third-party claims resulting from that customer’s unlawful use of the Service, unauthorized collection or disclosure of student information, violation of intellectual-property rights, breach of the applicable agreement, or fraudulent or intentionally wrongful conduct.
This Section does not require an individual consumer or parent to indemnify Skhillz Academy to the extent such a provision is prohibited or unenforceable under applicable consumer law.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except where federal law controls.
For disputes not required to be resolved under a separate written arbitration agreement, the parties consent, to the extent permitted by law, to the appropriate courts located in Orange County, Florida, or the federal court serving that county where federal jurisdiction exists.
Consumer rights that cannot legally be waived remain unaffected.
23. Changes to These Terms
We may update these Terms. When changes are material, we will provide notice appropriate to the circumstances, such as posting an updated version, changing the effective date, or providing account or email notice where appropriate.
Where affirmative consent is legally required, we will request it.
24. Severability
If a provision is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in effect.
25. Entire Agreement
These Terms, together with applicable checkout terms, privacy documents, and any separate written institutional or professional agreement, constitute the applicable agreement concerning use of Skhillz Script™.
A separately signed agreement controls if it expressly conflicts with these standard Terms.
